1.1 Welcome to Book.YourTalent (hereinafter referred to as "the Platform"), an online artist booking and event management platform operated by Book.YourTalent, a company incorporated under the laws of the Dubai International Financial Centre (DIFC) with registered office at Innovation Hub (hereinafter referred to as "we," "us," or "our").
1.2 These Terms and Conditions ("Terms") govern your access to and use of our website, mobile applications, and services. By accessing or using our Platform, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Platform.
1.3 We reserve the right to modify these Terms at any time. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes.
2.1 "Client" refers to any individual or entity seeking to book talent or utilize our services.
2.2 "Artist" refers to any performer, entertainer, or talent represented on our Platform.
2.3 "Management" refers to the authorized representatives of Artists.
2.4 "Booking" refers to the engagement of an Artist for an event or performance.
3.1 Talent Booking Services
a) We facilitate connections between Clients and Artist Management for booking purposes. b) We do not make decisions on behalf of Artists or guarantee bookings. c) Our role is to present suitable Artists based on Client requirements and to facilitate communication between parties. d) Final booking decisions and contract terms are agreed upon directly between Clients and Artist Management.
3.2 Consultancy Services a) We offer expert guidance on artist selection, event planning, and budget management. b) Consultancy services are customized based on Client needs and may include, but are not limited to, venue selection, logistics planning, and regulatory compliance advice.
3.3 PR & Marketing Services a) We provide strategic PR and marketing services to maximize event impact. b) Services may include social media management, press releases, media liaison, and promotional strategy development.
4.1 To access certain features of the Platform, you may be required to register for an account.
4.2 You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4.3 You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account or password.
5.1 Talent Booking Fees a) We charge a 10% fee on successful bookings, calculated on the total booking value. b) A 10% security deposit of the total booking value is required from the Client prior to contract signing with Artist Management. This deposit will be held in escrow and applied towards the total booking fee upon successful completion of the event.
5.2 Consultancy Fees Fees for consultancy services are customized based on the scope and duration of the engagement. A detailed quote will be provided and agreed upon before the commencement of services.
5.3 PR & Marketing Fees Pricing for PR and marketing services is tailored to each custom-made plan. Fees will be clearly outlined in a separate agreement for these services.
5.4 Online Payment Fees Additional fees of 1% to 3% apply to online payments, depending on the transaction amount. These fees cover payment processing costs and are non-refundable.
5.5 Payment Terms a) All fees are due upon invoice unless otherwise specified in writing. b) Late payments may incur additional charges and may result in suspension of services. c) All fees are non-refundable unless explicitly stated otherwise.
6.1 Booking Process a) Clients initiate the booking process by clicking the 'Book Your Talent' button on our website and completing the provided form. b) Our smart assistant reviews the submitted form to understand the client's requirements. c) We connect the client with one of our experienced booking experts who has prior experience working with artists and managers. d) The booking expert consults with the client, prepares official offers, provides guidance, and may suggest alternative talents suitable for the event. e) Following the expert consultation, we send the client a link to pay a deposit. f) The deposit is held in a secure pool as a commitment guarantee and to demonstrate trust to artist managements. g) If a deal is confirmed with artist management within 30 days, we facilitate direct communication between the client and management for contract signing. h) If no contract is signed within 30 days, 100% of the deposit is refunded to the client.
6.2 Deposit and Refunds a) A deposit is required to proceed with the booking process after the expert consultation. b) The deposit amount will be specified based on the nature and scale of the booking. c) Deposits are fully refundable if no contract is signed within 30 days of payment. d) Once a contract is signed, the deposit becomes non-refundable and will be applied towards the total booking fee.
6.3 Cancellations a) Cancellation policies may vary depending on the specific booking and Artist. b) In general, cancellations made by the Client: More than 60 days before the event: 50% of the deposit is refundable 30-60 days before the event: 25% of the deposit is refundable Less than 30 days before the event: No refund of the deposit c) If the Artist cancels, the full deposit will be refunded to the Client. d) Force majeure events will be handled on a case-by-case basis.
7.1 All content on the Platform, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Book.YourTalent or its content suppliers and is protected by DIFC and international copyright laws.
7.2 Users may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform, except as incidental to normal web browsing or as expressly permitted in writing by us.
7.3 Any unauthorized use of the Platform may give rise to a claim for damages and/or be a criminal offense.
8.1 Users may be able to post, upload, publish, submit or transmit content ("User Content"). By making available any User Content on or through the Platform, you grant to Book.YourTalent a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised.
8.2 You agree not to post User Content that: a) Is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable b) Infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party c) Contains software viruses or any other computer code designed to interrupt, destroy or limit the functionality of any computer software or hardware
9.1 To the fullest extent permitted by applicable law, Book.YourTalent and its affiliates, officers, employees, agents, partners and licensors shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: a) Your access to or use of or inability to access or use the Platform b) Any conduct or content of any third party on the Platform c) Any content obtained from the Platform d) Unauthorized access, use or alteration of your transmissions or content
9.2 In no event shall our total liability to you for all damages, losses or causes of action exceed the amount you have paid us in the last six (6) months, or, if greater, one hundred US Dollar(USD100).
You agree to defend, indemnify and hold harmless Book.YourTalent and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: a) Your use and access of the Platform b) Your violation of any term of these Terms c) Your violation of any third party right, including without limitation any copyright, property, or privacy right d) Any claim that your User Content caused damage to a third party This defense and indemnification obligation will survive these Terms and your use of the Platform.
11.1 These Terms shall be governed by and construed in accordance with the laws of the Dubai International
